Welcome to Miraajtech Trading Academy, operated by Miraaj-tech Africa Trading Unit (Reg. BN-VZSEKPAV), based in Mombasa, Kenya ("Miraajtech", "we", "us", or "our"). These Terms of Service (the "Terms") govern your access to and use of our website, educational content, signal services, communities, and any related products or services (collectively, the "Service").
By accessing the Service or purchasing a membership, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. The Service
Miraajtech provides educational materials, recorded and live trading sessions, market analysis, custom indicators, and trading signals focused on Smart Money Concepts ("SMC") with a primary focus on Gold (XAU/USD) and Forex pairs. The Service is delivered through our website, the Whop platform, and our private community channels.
2. Memberships, Billing & Refunds
All paid memberships are processed and managed through Whop. By purchasing a membership, you also agree to Whop's terms and billing policies.
- Subscriptions renew automatically until cancelled through your Whop account.
- You may cancel at any time; access continues until the end of the current billing period.
- Refunds are handled in accordance with Whop's refund policy. Due to the digital and immediate-access nature of the Service, refunds are generally not provided once content has been accessed.
3. No Financial Advice
Miraajtech is an educational platform. We are not a licensed broker, investment adviser, or financial planner. All content, signals, analyses, and opinions are provided for educational and informational purposes only and should not be relied upon as the sole basis for any trading decision. Always do your own research and, where appropriate, consult a licensed professional in your jurisdiction.
4. Trading Risk Disclosure
Trading foreign exchange, contracts for difference (CFDs), commodities, cryptocurrencies, and other leveraged or derivative products carries a high level of risk and may result in the loss of all invested capital. Past performance is not indicative of future results. The signals and setups shared by Miraajtech are not guarantees of profit. You should only trade with capital you can afford to lose.
5. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a binding contract to use the Service. You are responsible for ensuring that your use of the Service complies with all laws applicable to you, including any restrictions on trading or copy-trading services.
6. Acceptable Use
You agree not to:
- Share, redistribute, resell, or republish any content, signals, recordings, indicators, or course materials.
- Share your account credentials or community access with anyone else.
- Reverse-engineer, decompile, or attempt to extract source code from our indicators or tools.
- Use the Service for unlawful, abusive, harassing, or discriminatory purposes.
- Misrepresent your identity or affiliation with Miraajtech.
Violation may result in immediate suspension or termination of your account without refund.
7. Intellectual Property
All content on the Service — including text, graphics, logos, videos, recordings, indicators, code, course materials, and signal streams — is the property of Miraajtech or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the content for your personal, non-commercial use during your active membership.
8. Custom Indicators
Indicators provided as part of the Service (including the "ORB Sessions" and "FVG & Order Blocks" indicators) are licensed for personal use only. Sharing the indicator files or source with non-members is prohibited and may result in permanent account termination.
9. Third-Party Services
The Service is delivered using third-party platforms including Whop, Discord, Telegram, TradingView, MetaTrader, and Cloudflare. Your use of those platforms is subject to their respective terms of service and privacy policies. Miraajtech is not responsible for the availability, content, or practices of third-party platforms.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any breach of these Terms or for conduct that we determine, in our sole discretion, to be harmful to the community or our brand. Upon termination, your licence to use the Service ends and you must cease using all materials provided.
11. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, Miraajtech and its founders, employees, contractors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, capital, or data — whether trading losses, missed opportunities, or otherwise — arising out of or related to your use of the Service. Our aggregate liability for any direct damages shall not exceed the amount you paid to Miraajtech in the twelve (12) months preceding the claim.
13. Indemnity
You agree to indemnify and hold harmless Miraajtech and its founders from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your trading activities.
14. Changes to the Terms
We may update these Terms from time to time. Material changes will be announced via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the Republic of Kenya, without regard to its conflict-of-law principles. Any dispute arising out of or related to the Service shall be subject to the exclusive jurisdiction of the courts of Mombasa, Kenya, except where mandatory consumer-law provisions in your country of residence provide otherwise.
